PREAMBLE

  1. These general conditions of sale are agreed between Biochok – Artesão de chocolate, Lda., based in Rua do Comércio, Lote 16, Zona Industrial Casal do Cego, 2415-830-Leiria, tax identification number 514 242 442 and mobile contact +351 933 000 002, hereafter referred to as “Company“ and the people wishing to make purchases through the website www.naudocacau.pt hereafter referred to as “User”.
  2. The parties agree that purchases made through the www.naudocacau.pt website shall be regulated exclusively by this contract with exclusion of any conditions previously available on the website.

 

ARTICLE 1 – OBJECT

  1. The present general sale conditions have per object to make available and define all the information required to the User on ordering, sale, payment and delivery of purchases made on www.naudocacau.pt website.
  2. These conditions regulate all necessary steps to perform the order and ensure follow-up of this order between the Contracting Parties.

 

ARTICLE 2 – ORDER

  1. User makes the order by completing the purchase process displayed on www.naudocacau.pt website, adding the product(s) or service(s) he wants to order from the shopping basket.
  2. To submit the order, the User shall:
  3. Register on naudocacau.pt website, providing for this purpose the information requested therein.
  4. To make the “login” (giving a combination of email and password chosen by the User in the registration act).
  5. Complete the information and choose the options made available to the User throughout the order ending process (delivery and billing address, form of shipping, form of payment, as well as the tax identification number and the name that, for tax purposes, the User want to constitute in the invoice).
  6. The final confirmation of the User order is equivalent to full and complete acceptance of the prices and description of the products available for sale, as of these General Selling Conditions that will be the only applicable to the contract so complete.
  7. The Company will honor the orders received online solely to the limit of the inventory available. If there is lack of product availability, the Company commits itself to inform the User as soon as it is possible.
  8. The data on the invoice are only User’s responsibility. The invoice after it is issued cannot be reissued with changes.
  9. The order requests have a validity of five days, except if the order is recorded under a promotional campaign that sets a different time frame, and it is not possible to ensure prices, discounts, promotions and offers beyond this time frame. If the payment is not received by our services within the said time frame, the order may not be delivered. Any amount received after this date shall be returned or used on a new order.

 

ARTICLE 3 – PAYMENT

On the naudocacau.pt website, the Company proposes to the User the following payment modalities:

  1. Bank Transfer;
  2. Paypal.

 

ARTICLE 4 – DELIVERY

  1. The delivery of the orders will take place up to five business days after the Company confirms the payment received for that order. Delivery is performed by the LOGISTA PARCEL or CTT companies.
  2. For delivery orders within mainland Portugal of less than €50, shipping costs of €9,59 are added to the amount.
  3. To orders with delivery in countries within the European Union of value under €100, shipping costs of €18 are added to the amount.

 

ARTICLE 5 – PRICES

  1. Prices must understand themselves in Euros, with fees and taxes included, taking into account the VAT in place at the date of order payment.
  2. In case there is an increase in the Prices of some product, the User will be informed immediately and may choose to receive his or her order (making the payment of the difference) or to proceed to it cancellation.

 

ARTICLE 6 – CANCELLATION AND DEVOLUTION

  1. The process of cancellation or return is treated on a case-by-case basis, by Biochok – Artesão de chocolate, Lda. The request shall arrive in writing for the email cliente@naudocacau.pt, until 1 day after order, with the cancellation or return instructions of the merchandise being answered and set by Biochok – Artesão de chocolate, Lda., through the same email writing.
  2. Whenever possible the return shall be held by the same payment method, but if it is not possible, the User must send the proof of payment and the proof of account owner or cardholder, so that the return can be done by Bank Transfer.
  3. A Biochok – Artesão de chocolate, Lda., pledges to reimburse the User no later than five working days.
  4. Products returned have mandatory to find themselves in selling conditions, which means that they have to be in the same state they have reached the hands of the User, without any anomaly or damage.
  5. If the resulting value of the exchange of products of an order is less or greater than the initial value of it, the hit conditions will be indicated by Biochok – Artesão de chocolate, Lda.

 

ARTICLE 7 – PRIVACY POLICY

Your data processing is carried out in compliance with legislation on personal data protection. These data, subject to computer processing, will be included in the database(s) of Biochok – Artesão de chocolate, Lda., and are intended for recording and presenting other products and services, as well as institutional information, provided by the same.

Providing your data is optional, and under the terms of the law, you are guaranteed the right of access, rectification and deletion of any data concerning you directly, either in person or in writing, directly to the address listed on the homepage of this website.
